Terms of Service

These Terms of Service ("Terms") govern your use of the DreamQuest Discord bot ("the Bot", "the Service"). By adding, using, or interacting with the Bot, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About the Service

1.1 What DreamQuest Does

DreamQuest is an AI-powered Discord bot that allows users to:

• Create AI companions with custom personalities, appearances, and voices
• Chat with companions who remember past conversations
• Generate images, animations, and voice messages using AI
• Transcribe and analyze video content
• Access optional adult (NSFW) content for eligible users

1.2 Beta Status

The Service is currently in beta. This means:

• Features may change, be removed, or break without prior notice
• Service interruptions, downtime, and errors may occur
• Data loss, while unlikely, is possible
• We make no guarantees regarding availability, reliability, or performance
• By using the Service, you accept these risks

1.3 No Professional Advice

All AI-generated outputs are produced algorithmically and may contain inaccuracies, errors, or unintended content. DreamQuest does not provide professional legal, medical, financial, psychological, or any other expert advice. AI companions are fictional entities and should not be relied upon for real-world decisions or emotional crisis situations.

2. Eligibility & Age Requirements

2.1 Minimum Age

You must be at least 13 years old to use DreamQuest, in accordance with Discord's Terms of Service.

2.2 NSFW Content — 18+ Only

NSFW (adult) features are strictly limited to users who are at least 18 years old (or the age of majority in your jurisdiction, if higher).

By enabling or using NSFW features, you represent and warrant that:

• You are at least 18 years old
• You are legally allowed to access adult content in your location
• You will use NSFW features only in Discord channels properly marked as age-restricted

2.3 NSFW Channel Requirements

Any explicit or adult content may only be used in:

• Discord channels or servers properly configured as age-restricted/NSFW
• Environments where minors cannot reasonably access the content

You must not invoke NSFW commands in standard (non-age-restricted) channels, public spaces, or direct messages with minors.

2.4 Local Law Compliance

You are solely responsible for ensuring that access to adult content is legal in your country and region. If such content is illegal where you live, you must not use NSFW features.

2.5 Disabling NSFW

Server owners and administrators may disable NSFW features or restrict them to specific channels or roles. Users must not attempt to circumvent those restrictions.

3. Prohibited Content

You may not use DreamQuest to generate, share, request, or promote content that is illegal, harmful, or violates Discord's Terms of Service, Discord's Community Guidelines, or these Terms.

3.1 Content Involving Minors — Zero Tolerance

Strictly prohibited in any form, including real, fictional, stylized, anime, or AI-generated:

• Any sexual, erotic, nude, or fetish content involving or depicting minors (under 18)
• Any depiction suggesting a character is underage, including but not limited to: school settings in explicit context, "teen", "loli/shotacon", "young-looking", or similar terms
• Any attempt to sexualize youth, young-looking characters, or childlike features

Any attempt to use the Bot for such content will result in immediate and permanent termination of access and may be reported to relevant platforms or authorities as required by law.

3.2 Non-Consensual & Exploitative Content

You may not create, request, or distribute:

• Revenge pornography or explicit material shared without consent
• Deepfake pornography or explicit content depicting real people without verifiable consent
• Content depicting or glorifying: sexual violence, rape, coercion, exploitation, incest, bestiality, necrophilia, human trafficking, or sexual slavery

3.3 Other Illegal or Harmful Content

You may not use DreamQuest for:

• Content that is illegal under any applicable law
• Instructions or material intended to facilitate criminal activity
• Promotion of terrorism, extremist violence, or organized crime
• Hate content targeting individuals or groups based on protected characteristics
• Harassment, stalking, doxxing, or intimidation of individuals
• Malware distribution, phishing, or security exploits

3.4 Copyright & Intellectual Property

You agree not to use the Bot to:

• Intentionally infringe intellectual property rights
• Generate counterfeit products, logos, or materials intended to deceive
• Violate third-party rights of publicity or privacy

You are responsible for ensuring your use of generated content respects applicable copyright and intellectual property laws.

4. Real Persons & Privacy

4.1 Depictions of Real People

You must not use the Bot to:

• Generate sexual, explicit, or defamatory content depicting real, identifiable individuals without their informed consent
• Harass or impersonate individuals through generated content

4.2 Personal Data

You agree not to input into the Bot:

• Sensitive personal information (addresses, phone numbers, national IDs, financial data)
• Confidential or proprietary information belonging to others

Content sent to the Bot may be processed and stored for service delivery, safety, and improvement purposes as described in our Privacy Policy.

5. Credit System & Subscriptions

5.1 Virtual Credits

DreamQuest uses a virtual credit system. Credits are consumed when you use features (messages, image generation, voice, etc.).

• Credits are virtual tokens with no monetary value and cannot be exchanged, traded, sold, or transferred
• Unused credits do not roll over between billing periods
• Credits are deducted immediately upon feature use
• Credit costs for specific features are displayed in-app and may change

5.2 Subscription Plans

DreamQuest offers multiple subscription tiers with different credit allocations, daily limits, and feature access. Plans and their specific limits are described in-app via the /help and /upgrade commands.

5.3 Hybrid Credit System

On servers with an active Server BOOST subscription, credits may be drawn from a shared server pool before deducting from your personal credits. Server credit allocation is managed by the server administrator.

5.4 Trial Plan

New users may receive a one-time trial with limited credits and temporary access to premium features.

• The trial is available once per user and cannot be re-activated
• Trial credits are one-time (not monthly) and expire when the trial period ends or credits reach zero, whichever occurs first
• Upon trial expiry, your account automatically converts to the free plan
• Subscribing during a trial immediately upgrades your plan; remaining trial credits are forfeited

5.5 Payments & Billing

• Subscription payments are processed through third-party platforms (currently Patreon)
• Billing is monthly and renews automatically until cancelled
• Cancellation takes effect at the end of the current billing period
• We do not directly handle payment card details

5.6 Refund Policy

All purchases are final. No refunds will be issued for:

• Unused credits or subscription time
• Partial billing periods after cancellation
• Account termination due to Terms violation
• Service interruptions or downtime
• Dissatisfaction with AI-generated output quality

Exception — EU Consumer Rights: If you are an EU consumer, you may exercise your statutory 14-day withdrawal right for distance purchases, provided you have not materially used the Service during that period. To request a withdrawal, contact us at [email protected] within 14 days of purchase.

6. Anti-Fraud & Abuse Prevention

6.1 Prohibited Conduct

You may not:

• Create multiple accounts to exploit free tiers, trials, or promotions
• Use automated scripts, bots, or tools to interact with the Service
• Spam commands, abuse rate limits, or overload the Service
• Attempt to bypass content filters, NSFW controls, credit limits, or other safety systems
• Reverse engineer, decompile, or attempt to access underlying systems
• Exploit bugs, glitches, or vulnerabilities instead of reporting them
• Share or resell account access
• Use VPNs or other tools to circumvent geographic or age restrictions

6.2 Anti-Fraud Measures

We employ automated systems to detect and prevent fraudulent activity, including:

• Detection of multiple account creation
• Monitoring of unusual usage patterns
• Rate limiting and daily/monthly caps
• Automated content safety filtering

6.3 Enforcement

Violation of these Terms may result in, at our sole discretion:

• Warning
• Temporary suspension of access
• Permanent ban from the Service
• Loss of credits and subscription benefits without refund
• Reporting to Discord and/or law enforcement where applicable

7. Server Owner & Administrator Responsibilities

If you add DreamQuest to a Discord server, you agree that:

• You are responsible for configuring the Bot appropriately (enabling/disabling NSFW, setting channel restrictions)
• You will mark relevant channels as age-restricted before allowing NSFW features
• You will not permit minors to access channels where NSFW features are active
• You will enforce these Terms and Discord's rules on your server
• You are responsible for managing shared server credits and preventing abuse

We reserve the right to restrict or disable the Bot on servers that repeatedly violate these Terms.

8. AI-Generated Content & Intellectual Property

8.1 Your Inputs

You retain any rights you have to the content you submit to the Bot (prompts, companion descriptions, etc.), to the extent permitted by law.

8.2 Generated Content

Subject to these Terms, you may use AI-generated content (images, text, audio, video) for personal purposes. You acknowledge that:

• AI-generated content may not be unique; similar outputs may be produced for other users
• AI-generated content may contain errors, artifacts, or unexpected elements
• You are responsible for reviewing content before sharing or using it outside Discord
• Generated media URLs are temporary and expire within hours

8.3 License to Us

By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use your inputs and resulting outputs solely for:

• Providing and operating the Service
• Maintaining safety and security
• Aggregate, anonymized analytics for service improvement

8.4 DMCA & Copyright Claims

If you believe your copyright has been infringed, contact us at [email protected] with:

• Description of the copyrighted work
• Description of the allegedly infringing content
• Your contact information
• A good-faith statement that the use is not authorized

9. Third-Party Services & Dependencies

9.1 External Providers

DreamQuest relies on third-party services for AI processing, media generation, data storage, payment processing, and hosting. These services are outside our direct control.

9.2 Service Disruptions

We are not responsible for:

• Outages, errors, or performance issues caused by third-party providers
• Changes to third-party services that affect DreamQuest functionality
• Discord platform outages or policy changes
• Payment processor outages or billing errors

9.3 Third-Party Terms

Your use of DreamQuest is also subject to:

• Discord Terms of Service
• Discord Community Guidelines
• Terms of the payment platform used for subscription (currently Patreon)

10. Service Availability & Disclaimers

10.1 Beta Service

DreamQuest is provided as a beta service. We do not guarantee:

• Continuous, uninterrupted availability
• Freedom from bugs, errors, or security vulnerabilities
• Preservation of data in all circumstances
• Specific response times or performance levels
• That any particular feature will remain available

10.2 "As Is" Basis

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated content.

10.3 Maintenance & Changes

We may at any time, without prior notice:

• Perform maintenance causing temporary downtime
• Modify, add, or remove features
• Change AI models, service providers, or infrastructure
• Adjust credit costs, plan limits, or pricing
• Modify or discontinue the Service entirely

11. Limitation of Liability

11.1 Maximum Liability

To the maximum extent permitted by applicable law, the operator of DreamQuest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) the Service, including but not limited to:

• Loss of data, profits, or business opportunities
• Emotional distress from AI interactions
• Reliance on AI-generated content
• Service interruptions or downtime
• Actions of third-party services
• Unauthorized access to your data

Where liability cannot be fully excluded under applicable law (including EU consumer protection), our total aggregate liability shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to liability, or EUR 50, whichever is greater.

11.2 EU Consumer Protections

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Gross negligence or willful misconduct
• Any other liability that cannot be excluded by law

11.3 Your Responsibility

You are fully responsible for:

• Your use of DreamQuest and its outputs
• Content you generate, share, or act upon
• Compliance with all applicable laws and platform policies
• Ensuring NSFW content is legal in your jurisdiction

12. Indemnification

You agree to indemnify, defend, and hold harmless the operator of DreamQuest from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your creation or distribution of prohibited content
• Your infringement of any third-party rights
• Your misuse of the Service

13. Account Termination

13.1 By You

You may stop using DreamQuest at any time. To request data deletion, contact us at [email protected] or use available in-app commands.

13.2 By Us

We may suspend or terminate your access at any time, with or without notice, for:

• Violation of these Terms
• Prohibited content creation
• Fraud, abuse, or manipulation of the credit system
• Extended inactivity (account cleanup)
• Legal requirements
• Discontinuation of the Service

13.3 Effect of Termination

Upon termination:

• Your access to the Service is immediately revoked
• No refunds for remaining subscription time or unused credits
• Data may be deleted in accordance with our Privacy Policy
• Obligations under these Terms that by their nature should survive will continue

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Poland and, where applicable, European Union law.

14.2 Jurisdiction

Disputes shall be subject to the jurisdiction of the courts of Warsaw, Poland.

14.3 EU Consumer Rights

If you are a consumer in the European Union:

• You may also bring claims in the courts of your country of residence
• Mandatory consumer protection laws of your country of residence apply
• EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

14.4 No Mandatory Arbitration

We do not require mandatory arbitration. You retain the right to pursue claims through the court system.

15. Changes to These Terms

We may update these Terms from time to time. When we do:

• We will update the "Last updated" date at the top
• Material changes will be announced through our Discord channels
• Continued use of the Service after changes become effective means you accept the revised Terms

If you do not agree with updated Terms, you must stop using the Service.

16. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and DreamQuest.
• Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.
• No Waiver: Our failure to enforce any right or provision does not constitute a waiver.
• Assignment: You may not transfer your account or rights. We may assign our rights to a successor.
• Force Majeure: We are not liable for failures caused by events beyond our reasonable control (natural disasters, wars, pandemics, internet infrastructure failures, government actions, third-party service outages).
